Terms of Service | Attentico

1. About Attentico

Attentico is an AI-powered gifting service that allows users to manage, automatically select, and send gifts and cards for birthdays, anniversaries, and other special occasions. By creating an account and using Attentico you agree to these Terms of Service.

2. Accounts & access

You are responsible for:

the accuracy of your account information
keeping your password confidential
all activity that occurs under your account

You may not transfer your account to a third party without our consent.

3. Subscription & payment

Attentico Personal is free. Attentico Work is billed monthly per employee via Stripe.

Payment is made in advance for the current month.
You may cancel at any time via Settings → Billing. The subscription remains active until the end of the paid period.
We do not offer refunds for partially used months.
In case of failed payment we reserve the right to suspend the service after a reasonable notice period.
All prices exclude VAT unless stated otherwise.

4. Google Contacts integration

Attentico offers an optional Google Contacts integration. By using this feature you grant Attentico permission to read your Google Contacts on a one-time basis (read-only). The following conditions apply:

We import only: name, email address, phone number, and birthday.
We use Google data solely to create contacts in your Attentico account — never for advertising, profiling, or sale.
You can revoke access at any time via myaccount.google.com/permissions.
Our use of Google API data complies with the Google API Services User Data Policy, including the Limited Use requirements.

5. Acceptable use

It is not permitted to use Attentico for:

illegal activities or fraud
spam or unsolicited communications
violating the privacy or intellectual property rights of others
automated scraping of the service without permission
uploading malicious software

We reserve the right to deactivate accounts in case of misuse, without prior notice.

6. AI-generated content

Gift suggestions and card messages are generated by AI (Anthropic Claude). Attentico does not guarantee that AI suggestions are error-free, complete, or suitable for your specific situation. You are responsible for reviewing and approving AI-generated content before use.

7. Gift orders & deliveries

Gift orders are fulfilled via third parties. Attentico is not liable for delays, damage, or failed deliveries by third parties. For order issues you must contact the relevant supplier directly. Autopilot orders are executed based on your settings — you are responsible for keeping autopilot preferences and delivery addresses up to date.

8. Intellectual property

All rights to the Attentico software, platform, brand name and content are owned by Attentico or its licensors. You may use the service for personal or business use in accordance with these terms, but you may not copy, decompile, or distribute the software.

9. Liability & warranties

Attentico provides the service 'as is'. We strive for high availability but do not guarantee uninterrupted operation. Attentico is not liable for:

indirect damage, lost profits, or consequential damage
damage due to late or failed deliveries by third parties
damage from unauthorised account access resulting from your own negligence
data loss due to circumstances beyond our reasonable control

Our total liability is in all cases limited to the amount you paid to Attentico in the preceding 3 months.

10. Termination

You may delete your account at any time via Settings → Data → Delete account. After deletion all your data will be permanently erased within 30 days. Attentico reserves the right to terminate accounts that violate these terms.

11. Changes to the terms

We may update these terms. For significant changes we will notify you by email at least 14 days in advance. Continued use of Attentico after the effective date of the new terms constitutes acceptance.

12. Governing law

These terms are governed by Dutch law. Disputes are subject to the jurisdiction of the competent court in the Netherlands.
